Mr. N. Thilekaratna is a resident of no 31, Dobawela, Mahawela, Matale. He has made written complaints to the Chief Justice, secretary of the Judicial Service Commission and the Attorney General on 04.06.2014 regarding his case bearing number 20754 hearing at the Magistrate court, Matale. He is the accused of this case.
One day in the first three months of this year his motorcycle was stopped by Rattota police and examined all the documents. The police neither charged nor issued a charge sheet against him. One day the police had handed over a summon to his relative. According to the summon he has appeared before the Matale Magistrate court on 30.05.2014 at about 8.30 am.
He was waiting at the court until 4 pm but his name or the number of the lawsuit did not call. After the end of the court session he went to a court staff member and inquired the matter. After that a police officer and that female staff member accompanied him to the chamber of the Magistrate. When the Magistrate asked him whether he pleads guilty or innocence he pleaded innocence. After that the Magistrate ordered to release him on cash bail of Rs.2000/= and a surety valid Rs.100000/=.
His friend Nandika Ellepola came to the court to pay the bail money. He met the registrar. But he was not allowed to do so because has had lawsuits. Then he accompanied another friend to pay the bail money. When they went to pay the money to the cashier she said the duty was over and refused to receive the bail money.
So Mr.N Tilekaratna was failed to receive bail. He was remanded. He was released on 03.06.2014 from the courts. On 03.06.2014 when his friend’s mother went to fulfill the bail conditions she was harassed and suffered by the court staff.
This is a planned crime and a fabrication of charge by the Rattota police and the court staff of Matale. He requests to take legal actions against the relevant officers and release from this fabrication of charge. He further requests to order the registrar of the Matale court and the OIC of the Rattota police to issue the copy of the case record and the copy of the first complaint.
