Ancient Kings, Present Rulers and Human Rights

The present ruler’s evil acts corruption, bribery, extrajudicial killings, torture, abductions  diappearances and other violations of Human Rights remember ancient kings’ loyalty to justice and human rights.

King Duttugemunu killed king Ellara. He made a tomb for the memory of this Tamil king and imposed a rule that every passer by getting down from the horse back and honour it. This remembers the behaviour of some southerners after the killing of LTTE smiling face Thamilchelven. They fired crackers and celebrated.

The present ruler is also the leader of military and police. The most recent inhumanity of these military forces was display of naked bodies of the LTTE carders after they attacked Anuradhapura air base. Anuradhapura is one of the most sacred places for Buddhists.

King Ellara was very fair and impartial. One day a calfe was killed in an acident occured from his son’s failure. The king gave the judgement against his son. What was happened in Malaka Silva’s case? His father is a member of the present parliament which is the symbol of people’s sovereignity. He did every thing by hook or crook to rescue his son.

The present cabinet comprises of two ministers who alleged for corruption by the COPE report. The crossovers MP Duminda Silva and Mahinda Rathnathileka were accepted to the government ignoring their chargers on rape and murder. The most shameful thing was given a non-cabinet portforlio to Mahinda Rathnathileka.

The great king Parakramabahu the 2nd in 13th century B.C abolished death penalty and life long imprisonment. King Vorharica Tissa in the 3rd century B.C was the first king to suspend physical punishment. Now the present ruler’s law enforcement agency commits torture.They are also responsible for considerable number of abductions and disapperances. They want to end crimes   by extrajudicial killings. Unfortunately these officers still beleive the theory which was condemed by civilised soceities” eye to eye “or “tooth to tooth”.

King Buddhadasa was famous for careing and naturing animals. He cured a sick snake. We all knew the case of Ashokamala a seven year old female elephant. The case has gone to the Supreme court. The higher authorities in the present ruler’s government like minister Gamini Lokuge still trying their best to send this animal to the Yerevan  zoo in Aremenia which is unsuitabale for the elephant.

King Udaya the 4th made a stone structure called “Hopitigamuwa tam lipiya”. Through this he imposed several rules regarding the protection of consumer rights. Today there is no  efficient way to handle consumer affairs. Media has reported two incidents very recently. There was a pen tourch battery in a soft drink bottle and the small boy who had drank it fell sick. The second incident took place where the lady justice remains Colombo law library . A lawyer bought a lunch packet from the law library canteen and found a small nail in it.

The memory of ancient kings still makes us feel great, proud and happy. It also makes frustration of our present rulers. People are the victims of present ruler’s misbehaviour and injustice. There are two questions raise in every resonable mind. What will be the solution for the suffering of people? and Where will it?

Musharraf type Mihin

 President Mihin of the pearl of Indian ocean expressed strong objections behalf of his country at the decision taken to suspend Pakistan from membership of the Commonwealth at the Commonwealth Heads of Government Meeting.

 Media has reported “One of Musharrafs main aims in declaring the emergency was to purge the Supreme Court of judges who appeared set to annul his re-election by parliament last month.The court now packed with pro-government judges is expected to strike down the last of six petitions .”

 Mihin’s regime is a family business. But for the fortune of his country men courts are not worse than Musharraf’s  extent. His military sibilings were allegedly attacked “Leader”. They also  allegedly attacked  his political opponant’s house “Sripathi”. This said persons have suported the terrorist group led by one called “Pillayan”. This is shameful for the democraticaly elected government. We knew that our friend Musaharraf is strongly condem terrorism “al queda” although he came to power by military coup.

Musharraf ’s recent visit to Saudi Arabia had sparked speculation he would either reach out to former minister Nawaz Sharife or seek to prolong his exile there. He has sought support from another former prime minister Benazir Bhutto but his strategy up to now has been to marginalise Sharif the man he deposed in a 1999 coup.

The final vote for Mihin’s budget will under threat. The victory will be crucial. Will Mihin seek  support from the opposition like Musharraf to form a national government?Musharraf has said he’s going to take off his uniform. Will our Mihin going to wear it?

If Mihin is a true leader of man kind he will support the struggle of Pakistani people. Commonwealth’s decision is not against people’s democracy but to protect it from military ruler Musharraf.

New Bill and Jerald Perera

The government is in a hurry to present the new bill on victim and witness protection at the parliament. Media has reported it will be present to the parliament after the conclusion of the budget debate. This is good.

The UN special rapporteur on torture Manfred Nowak visited the country very recently. He issued a statement on torture which prevails in the country. He has made several recomendations to the government. One of his prorities is develop proper mechanisms for the protection of torture victims and witnesses.

This new bill remembered late Jerald  Perera. Jerald Perera was a torture victim and a main witness of his High Court case when he was killed. Wattala police tortured him after arresting on false information. He filled a fundamental rights pettition at the Supreme court. Jerald won the case. Justice Mark Fernando mentioned there was no justifiable reason to arrest Jerald. He further mentioned the information was not even possible to question him over the charge-murder.

Jerald was killed on the 24th of November 2004. His neighbours and friends in his village “Hadella” will organise a commemoration on 23rd November. The People Against Torture with Janasansadaya and Asian Human Rights Commission will commemorate this humble and brave man organizing a seminar on vitim and witness protection. This will be held at the Foundation Institute on the 26th November.

The parliament of Sri Lanka has passed several acts on preventon of crimes. Torture Act is one example. The state has already ratified considerable number of international treaties on human rights. But incidents like Jerald Perera are reported from almost all parts of the country. This must be stop. The honest willingness and courage of the government can eradicate this epidemic-torture. Otherwise the new bill also limit to the paper.

Re;Mahinda Rajapakse and Velupillai Prabakaran

The above topic was in an article which was written by Victor Ivan to Ravaya newspaper. The article was clear but somekind of confusion raises in reader’s mind.

It said about the main causes for war responsible by country’s former Sinhala Buddhist politicians. There are true. We all agreed S.W.R.D’s language policy was the foundation stone for the North East crisis. Now we are people under a government which rule by Sinhala Buddhist extremist leader Mahinda Rajapakse.

The editor has remembered several incidents in international politics to compare the LTTE’s gurrilla war. He has also mentioned about the “ahimsa” of Mahatma Gandhi. Those are very good.

But the confusion is emerged on the issue who has the responsibility to cease the war. The writer’s suggestion was Velupillai Prabakaran. LTTE is powerful no doubt about it. But how about the state? According to my view the state under the control of extremist Sinhala Buddhist leader is still more powerful than the LTTE.

LTTE is not the first person to open the cage for peace dove. It will be our president Mr.MR.

Good Luck COPE chief

The cross over of COPE chief and his seven demands are good at this depress situation which prevail in the country. His seven demands are appreciated by every conscious person in the civil society.

His first demand is the reduction of the cabinet to 30. In recent times Sri Lanka has become well known to international politics for its current jumbo cabinet.Their expenditure depends on people’s wallets. The poorer suffer while the members of the jumbo cabinet enjoy various privelleges. His fourth demand is cut down of allocation for the president and ministers to Rs 5billion. If the government accepted this demand and put into practice it will gain 99.9% people’s vote.

There are corrupt members in the government.Their corruption is not challenged. Some honest attempts bring them to justice end in astray. So Mr. Wijedasa Rajapakse’s second and third demands are crucial. There are the expulsion of two Cabinet ministers held responsible by COPE and stripp Treasure Secretary P.B .Jayasundera and Inland Revenue Department Chief A.A.Wijepala from their positions.

The war is continuing. The authorities insists military solution in public. Not only Tamils but Sinhalese specially in Habantoto have affected as a result of  this dirty war. So this brave lawyer’s fifth demand  appointment of a Parliamentary Select Committee to work out a political solution to the national question is no doubt every peace lover has appreciated.

Everybody wittness an exceptional collapse of the Rule of Law. Dissapperances , extrajudicial killings, abductions and torture are become essential norms in day to day life. So his demand to appoint an active Justice Minister seems to have impact to stop deterioration in law and order.

His last demand is to report parliment how the allocations to Finance Ministry are spent. Transparency will make people friendly government. It is an important aspect of good governance. So every citizen who concerned about better Sri Lanka wishes good luck to Mr. WR.

No Race, Religion, and Language

Extra judicial killings are reported from every part of the country. The perpetrators of this crime mostly the police and the military do not care about victim’s race , religion and language.

Some of the recent cases are five youths killing in Yavuniya,  killing of two suspects of Delgoda massercre and the suspect suicide at the Hirana ferry while in police custody. This is a grave violation of Human Rights. It is a reflection of the destruction of the Rule of Law prevail in the country.

According to the Rule Of Law no person is above the Law. This is similar to village man and the highest post held by the executive president. The most significant incident where the president violates the law was appointed to the independent commissions ignoring the 17th amendment to the  supreme law of the country – 1978 constitution.

If suspects are killed without court decisions then there is no need for a law. People also do not want judiciary. They do not want to access to the service of lawyers. Extra judicial killings has caused to a law lessness in the country. If it will develop further people may take law into their own hands. So it will create a situation for the jungle law enforcement macinery.

Police or military personnel cannot act accoding to their own wishes.Law is above them. If someone think extra judicial killings are the only remedy to prevent crimes it is a myth. Some educated persons also belive in this method. It is sad to say although they are well educated not intelligent.

Majority of people are still silent about this tragedy. It is an approvel to this unlawful act. We all must remember what Dr. Martin Luther King said.”We shall have to repent in this generation Not so much for the evil deeds of the wicked people ,But for the appalling silence of the good people.”

UNP and Daily Mirror

Media has reported the UNP leadership contacted Daily Mirror lobby correspondent Kelum Bandara and reprimanded him for the newspapers failure to publish the UNP statement on the budget.

Daily Mirror editor replied to the UNP under the heading “UNP and Media Freedom”. The position that has taken by Daily Mirror is a role model to any media whether it is press or electronic. This reply is a reflection of independent journalism which seems to be still prevail in the country.

No politician has a right to interfere media whether he or she represents government or opporsition. If this was the behaviour of UNP when it is in the opporsition we can imagine who they are when they will come to power.

Migrants are not only workers………

Media reported three Sri Lankan maids aged 52 years, 32 and 30 have been admitted to a hospital following a failed attempt to commit suicide in Kuwait. The maids are reportedly working for a family in Bayan and they allegedly consumed quantities of medicine pills to end their lives.

Few months ago the plight of 19 year old Rizana Nafeek the teenager charged with suffocating a four month old child in Saudi Arabia shocked the nation.

Yesterday Rajapakse government presented the 2008 budget proposal to the parliment. The president said this year’s foreign investment close to 650 million dollers. Two years ago it was 250 million dollers. The foreign currency which sent by  Sri Lankans who have worked in abroad increased to 2700 million dollers this year. If their capabilities will develop this amount can be increase to 4.0 billion dollers.

So it is well known to the nation after presidents budget speech the importance of migrant workers.  Unfortunately in Rizana’s case government didn’t pay a rupee to her law suit. All are keen on foreign currency send by migrant workers but nobody concern on their and their families’ wellbeing. How many cases on this kind of exploited were not reported?

Sri Lanka ratified the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families on 16.03.1996. Sri Lanka is also a state party to the UN Convention on Migrants’ Rights which entered into force on 1st July 2003. A prority of the convention is protect and promote  human rights of migrants.

The UN convention does not create new rights for migrants but aims at guaranteeing equality of treatment and the same working conditions for migrants and nationals. This implies preventing inhumane living and working conditions ,physical and sexual abuse and degrading treatment.(articles 10-11,25,54)

Sinhala news papers reported three Sri Lankans in Qarter died after fire erupted in the hostel where they were stayed. The government has a grave responsibility when migrant workers killed, injured and filled charges against them. Both the sending state and the receiving state must treat them with humanity because they are not only workers ,they are also human beings.

According to the Convention receiving stae must ensure their right to legal equality which implies that migrant workers ars subject to correct procedures have access to interpreting services and are not sentenced to disproportionate penalties such as expulsion.(articles 16-20-22) This article is very important in cases like Rizana’s.

Migrants should also have the right to remain connected to their country of origin says the Convention. This implies ensuring that migrants can return to their country of origin if they wish to and that they are allowed to pay occasional visits and are encourged to maintain cultureal links. (articles 8,31,38)

According to media HRW Women’s Rights Division Researcher Jennifer Turner said “Amending the Penal code in April 2006 to criminalize trafficking has also had no great impact because the government has not taken positive steps to increase the accountability of agents and subagents “.

Sri Lankan government has a grave responsibility to protect and promote rights of migrant workers. As a state party to the said conventions they promised to the whole world that they comitted to fulfill their obligations. We must remember that nobody bullied our state to ratify these conventions.

“Ashokamala” speaks loudly

Hi ,You all have known my name very well now. I am a nine year old female elephant. I  have been lived with my relations and friends peacefully until the crucial decision of the authorities to send me to the Yerevan zoo in Armenia.

I have a friend who became my agent after this unfair decision. He has a NGO based on animal rights. He appeared for my rights and filled a fundamental rights pettion at the supreme court. Through this pettion my friend alleged the authorities about sever hardships that I have to face if I will send to the Yerevan zoo.

The court understood my grievances and granted leave to proceed . They further issued an interim order restraining me to the said zoo untill November 21st. Now I am very happy.I heard my reltives and friends discussing that the majority Sri Lankans  are still willing to protect and promote animal rights.

After the court decision I went to thank my friend. He seems to be not happy as I expected. I asked him Why? He says our battle is not over. He said it is not an easy task to seeking redress from Sri Lankan judicial system. Speedy justice is impossible. Lawyer’s pavements are difficult to afford.

At the end I understood the collapse of rule of law which prevails in the country for some decades.
